The provider of the “slot booking tool” (hereinafter: “Tool”) is Volkswagen AG, Berliner Ring 2, 38440 Wolfsburg, Germany, registered in the commercial register of the Braunschweig District Court under the number HRB 100484 (Volkswagen AG) and/or the respective partners of Volkswagen AG, who are named in the imprint or the provider identifier of a definable area (e.g. subpages).

All contents have been carefully checked by Volkswagen AG. Volkswagen AG makes every effort to ensure that the content on the tool is up-to-date and correct. However, no guarantee can be given for the completeness, correctness, timeliness and constant availability.

Volkswagen AG assumes no responsibility for the content and availability of third-party websites that can be accessed via external links. Volkswagen AG also assumes no responsibility for the content and availability of such definable areas (e.g. subpages) whose providers are partners of Volkswagen AG. Volkswagen AG expressly dissociates itself from all content that may be relevant under criminal or liability law or that offends common decency.

1. Contents of the tool

The user (hereinafter referred to as “User” or “Participant”) may book limited contingents free of charge via a digital booking route offered by Volkswagen AG.

The tool can be accessed through several ways:

• in the app offered by Messe München GmbH
• via the main page and its subpages of Volkswagen AG (Volkswagen.de).

The following promotions can be booked:

• Test drives (vehicle provided by Volkswagen AG)
• Guided tours of the stand (open space)
• Kids Tour (Open Space)

2. Property rights to the contents of the tool

When using the tool, copyrights, name and trademark rights as well as other property rights of Volkswagen AG and third parties must be observed. Among other things, the images, music and trademarks presented by Volkswagen AG are protected. The use of the tool and its retrievability does not grant any license or other right of use.

3. Misuse of the tool

Any misuse of the tool must be avoided, in particular no security precautions may be circumvented. In addition, no equipment may be used or applications may be executed that could lead to damage or functional failure of Volkswagen AG facilities, in particular due to changes to the physical or logical structure of the servers or the network of Volkswagen AG or other networks. Commercial, systematic use of the tool is not permitted without the consent of Volkswagen AG.

 4. Rights of use and general obligations of users

The user receives the non-exclusive, non-transferable and non-sublicensable right to use the tool in accordance with these Terms of Use. The user must ensure that he does not violate applicable legal regulations or violate the rights of third parties.

In particular, the user undertakes not to copy, duplicate, otherwise reproduce, forward to third parties or distribute the content displayed in the tool.

When using the tool, the user must observe all intellectual property rights of Volkswagen AG and third parties, including in particular copyrights, name and trademark rights as well as other property rights. Among other things, the images, music and brands presented by Volkswagen AG, such as “Volkswagen” and “I.D.”, are protected.

The test drives are only permitted for private, non-commercial purposes. Commercial use or forwarding of the Volkswagen test drives is not permitted.

5. Separate conditions of participation for the test drive

The participant assures that at the time of the test drive she is the holder of a valid driving licence for the passenger cars driven by him during the test drive.

The valid driving licence and identity card must be presented to Volkswagen AG’s representative upon request before the start of the test drive. To take part in the test drive, a minimum age of 18 years is required. There is an absolute ban on alcohol (0.0 per thousand). Furthermore, participation under the influence of medication or drugs is prohibited.

Volkswagen AG reserves the right to exclude persons from the test drive if there are doubts about their unrestricted fitness to drive.

The participant undertakes to comply with the rules of the road. In the event of violations of the Highway Code or any other violation directly or indirectly related to the vehicle, participants acknowledge and accept that Volkswagen AG is entitled to disclose their names to the competent authorities, not least in order to protect the interests of Volkswagen AG itself.

In the event of a violation of the above-mentioned regulations, the representatives of Volkswagen AG present are entitled to exclude the participants from further participation. During the entire duration of the test drive, the representatives of Volkswagen AG are authorized to give instructions to the participants.

The participant undertakes to wear a seat belt during the entire test drive – as a driver as well as a passenger. The test drive will be accompanied by a representative of Volkswagen AG.

To participate in the test drive of the Volkswagen Driving Experience, accident insurance was taken out with the following benefits:

in the event of death: 50,000.00 euros

in the event of total disability: EUR 100,000.00

A claim must be reported in writing within 18 months of the day of the accident to: Volkswagen Insurance Brokers GmbH, Claims Management VW AG, Mailbox GH-GWZSR, P.O. Box 8141, 38131 Braunschweig.

6. Responsibilities of Volkswagen AG

Volkswagen AG shall be liable in accordance with the following provisions:

1. If Volkswagen AG has to pay for damage caused by slight negligence on the basis of the statutory provisions, Volkswagen AG shall have limited liability. In this case, liability only exists in the event of a breach of essential contractual obligations. This liability is also limited to the typical damage foreseeable at the time of conclusion of the contract.
2. Irrespective of any fault on the part of Volkswagen AG, any liability in the event of fraudulent concealment of a defect, from the assumption of a warranty and under the Product Liability Act remains unaffected.
3. The limitations of liability in this section do not apply in the event of injury to life, limb or health. Irrespective of any fault on the part of Volkswagen AG, any liability in the event of fraudulent concealment of a defect, from the assumption of a guarantee or a procurement risk and under the Product Liability Act remains unaffected.
4. The personal liability of the legal representatives, vicarious agents and employees of Volkswagen AG for damages caused by them through slight negligence is excluded. For damages caused by them as a result of gross negligence, with the exception of their legal representatives and senior employees, the relevant provisions shall apply to Volkswagen AG in section
   a) limitation of liability shall apply accordingly.
   d) The limitations of liability do not apply in the event of injury to life, limb or health.
5. Volkswagen AG shall not be liable for damages incurred by the user of the application as a result of unauthorized third parties using the user’s access data with or without the user’s knowledge, insofar as the user is responsible for this. It is possible that the user may be held liable for damages incurred by Volkswagen AG as a result of the use of the access data by an unauthorized third party.
6. There is no obligation to carry out the event after the above-mentioned contingents have been booked.

7. Final provisions

Volkswagen AG reserves the right to amend these Terms of Use in a manner that is reasonable for the user and only with effect for the future. Users will be expressly informed of any changes to the Terms of Use and asked to agree to the amended Terms and Conditions. Should one or more provisions of the Terms of Use be or become invalid, this shall not affect the validity of these Terms of Use.

The law of the Federal Republic of Germany applies. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

The exclusive place of jurisdiction for all claims arising from or in connection with the tool is the court responsible for Volkswagen AG.

By using the tool, the user agrees to the above provisions.
